Terms & Conditions

These terms explain the rules for using Pocket Museum and the responsibilities we each have when you use the app, website, and community services.

1. Agreement to these terms

These Terms & Conditions ("Terms") govern your access to and use of the Pocket Museum Android application, pocketmuseum.app, and related services (together, the "Services"). By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

2. Eligibility

You must be at least 13 years old to use the Services. If local law requires a higher age for you to consent to online services, you must meet that age or have authorization from a parent or legal guardian. You may not use the Services if applicable law prohibits you from doing so.

3. Accounts and authentication

Pocket Museum can be used in local-only mode without an account. Connected features require passwordless sign-in through a magic link sent to your email address. You are responsible for controlling access to your email account, devices, and active sessions, and for notifying us if you believe your account has been compromised.

Information you provide must be accurate, and you may not impersonate another person or create an account for someone else without permission.

4. License to use Pocket Museum

Subject to these Terms, Pocket Museum grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the Services for lawful personal or internal purposes. You may not copy, sell, sublicense, reverse engineer, interfere with, or attempt to gain unauthorized access to the Services except where applicable law expressly permits it.

5. Your content

You retain ownership of photos, descriptions, metadata, and other content you create or upload ("Your Content"). You represent that you have the rights needed to provide Your Content and that doing so does not violate law or another person's rights.

Private and synced content

You grant Pocket Museum a limited license to host, copy, process, transmit, and display Your Content only as needed to operate, secure, and improve the features you choose, including sync, backups, matching, shared groups, and support.

Public profiles and community submissions

When you intentionally publish content or submit it to the community reference database, you grant Pocket Museum a worldwide, non-exclusive, royalty-free license to host, reproduce, adapt for formatting, display, distribute, and use that content to operate and improve the Services and shared reference library. This license allows approved reference material to remain useful to the community even if you later close your account. Where supported, Pocket Museum will preserve contributor attribution.

6. Community review and moderation

Community submissions may be checked automatically and reviewed by moderators. We may approve, reject, edit metadata, de-duplicate, restrict, or remove submissions to protect quality, safety, rights, and reliability. Approval is not an endorsement, authentication, valuation, or guarantee that an item is genuine or correctly identified.

7. Acceptable use

You agree not to:

  • Upload unlawful, infringing, deceptive, abusive, hateful, or sexually exploitative content.
  • Misrepresent ownership, provenance, authenticity, condition, contributor identity, or item value.
  • Harass others, expose private information, or use the Services for unauthorized tracking or surveillance.
  • Probe, disrupt, overload, scrape, or bypass security, rate limits, moderation, or access controls.
  • Upload malware or use automated systems in a way that harms Pocket Museum or other users.
  • Use community content or recognition results to violate intellectual property or other rights.

8. Subscriptions and payments

Some features may require a paid subscription. Prices, billing periods, trial terms, and included features will be shown before purchase. Payments may be processed by Google Play or Stripe under their terms. Subscriptions renew automatically unless canceled through the applicable billing provider before renewal. Taxes may apply. Refunds are governed by applicable law and the billing provider's policies.

Promotional benefits and contributor rewards may have additional eligibility rules, are non-transferable unless stated otherwise, and may be changed or ended for future periods.

9. Intellectual property and copyright reports

The Services, software, visual design, trademarks, and original Pocket Museum materials are owned by Pocket Museum or its licensors and protected by law. These Terms do not transfer those rights to you. Copyright complaints are handled under our DMCA Policy.

10. Third-party services

The Services may rely on or link to third-party providers, including app stores, payment processors, email delivery, maps, and cloud infrastructure. Their products and policies are separate from ours. Pocket Museum is not responsible for third-party services outside our control.

11. Suspension and termination

You may stop using Pocket Museum at any time and may delete your account through available account controls. We may suspend or terminate access when reasonably necessary to address a Terms violation, legal obligation, security risk, harm to others, nonpayment, or material abuse of the Services. Where practical, we will provide notice and an opportunity to appeal.

12. Service changes and availability

Pocket Museum is evolving. We may add, change, or discontinue features and may experience interruptions. We will make reasonable efforts to protect synced data and communicate material changes, but you should keep independent backups of content that matters to you.

13. Disclaimers

To the fullest extent permitted by law, the Services are provided "as is" and "as available." Pocket Museum disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Recognition, community metadata, condition notes, and other results may be incomplete or incorrect and are not professional authentication, appraisal, insurance, tax, or investment advice.

14. Limitation of liability

To the fullest extent permitted by law, Pocket Museum will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or opportunities arising from the Services. Pocket Museum's total liability for claims relating to the Services will not exceed the greater of the amount you paid for the Services during the 12 months before the claim or US $100. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

15. Changes, governing law, and contact

We may update these Terms as the Services change. Material updates will be posted with a revised effective date, and continued use after an update takes effect means you accept the revised Terms where permitted by law. Applicable law determines the governing law, forum, and any rights that cannot be waived in your jurisdiction.
